These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and DeepMerchAI LLC, doing business as Ghost Directive ("Company"), concerning your access to and use of the services provided by the Company. By accessing the services, you acknowledge that you have read, understood, and agreed to be bound by these Legal Terms. IF YOU DO NOT AGREE TO ALL OF THESE LEGAL TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.


1 .Introduction

Ghost Directive is a real-world espionage game designed to provide an immersive and interactive experience for players engaging in live-action intelligence and covert operations within designated game areas. The game is operated by DeepMerchAI LLC, doing business as Ghost Directive. Participation is voluntary, and by accessing or engaging with the game, you agree to comply with all rules, guidelines, and conditions outlined in this document.

  1. Participation & Eligibility

Players must be 18 years or older to participate.

Players under 18 require parental or legal guardian consent and may have limited access.

By participating, you confirm that you are of legal age and mentally and physically capable of engaging in the game’s activities.

  1. Code of Conduct & Player Responsibilities

You agree to never engage in illegal activity as part of any mission.

You will not trespass, steal, harass, stalk, threaten, or impersonate real officials while playing.

You will not engage in violence or harm against other players or civilians.

If at any point you feel unsafe or in actual danger, you must disengage from the mission and, if necessary, contact emergency services.

You acknowledge that all interactions are part of an entertainment experience and do not reflect real-world espionage or government operations.

You are responsible for your own decisions. Missions take place in real-world locations where unexpected situations can arise. You must exercise sound judgment, act within the law, and prioritize safety above all else.

  1. Game Structure & Player Tiers

Ghost Directive operates on a structured membership system, allowing participants to enter at different levels of involvement:

  • Asset (Free Tier) – Passive roles, drop-offs, surveillance.
  • Operative ($29/month) – Mission setup, intelligence gathering.
  • Elite Operative ($59/month) – Advanced fieldwork, strategic influence.
  • Agent ($99/month) – Live interaction, high-level assignments.
  • Elite Agent ($149/month) – High-stakes missions, priority intelligence.
  1. Communications & Privacy

Ghost Directive utilizes an encrypted internal messaging system (g0st.net) for in-game communication. You agree to only use this system for gameplay-related exchanges.

Player data is stored securely and is used only for game administration purposes.

We will never sell or distribute personal information to third parties.

  1. Data Collection & Usage

    Ghost Directive collects and processes player data to enhance gameplay, maintain security, and administer services. The data collected includes:

    • Personal Information: Name, email address, mailing address, and phone number.

    • Payment Information: Billing details, credit card information, and transaction history.

    • Gameplay Data: Player activity, mission participation, and questionnaire responses used to customize the game experience.

    • Facial Recognition Data: Photos and videos submitted during in-game missions may be processed through facial recognition technology to distinguish between active players and bystanders.

    By participating, you consent to the collection and use of this data in accordance with our privacy policy. Player data is stored securely and will not be shared with third parties except as required by law or necessary for game operation.

    Players also agree to allow Ghost Directive to disclose photos or videos of them to other players, along with their cover identity details. No personal information, such as real name, address, or other sensitive details, will be shared.

    Players acknowledge that by participating in the game, there may be identifiable information in submitted media, such as visible license plates, background locations, or personal items. By playing the game, you assume full responsibility for this risk.  Ghost Directive is not responsible for any unintended exposure of identifiable information in submitted game media.

  1. Safety & Liability

Ghost Directive is designed to provide a structured and immersive experience, but participation is at your own risk.

Players participate at their own risk and acknowledge that real-world environments may contain unforeseen hazards.

Ghost Directive, its operators, and affiliates are not responsible for injuries, legal consequences, or damages resulting from player actions, negligence, or failure to follow the rules.

Ghost Directive assumes no responsibility for any interactions between players. If you choose to interact with other participants, you do so at your own risk.

You must comply with all local laws and regulations at all times. If a mission conflicts with legal boundaries, abandon the mission immediately.

If you are unsure about the legality or safety of any action, DO NOT proceed.

Players agree to waive liability and release Ghost Directive from claims related to participation.

  1. Limitations of Liability

IN NO EVENT WILL GHOST DIRECTIVE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR PARTICIPATION IN THE GAME, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GHOST DIRECTIVE ASSUMES NO RESPONSIBILITY FOR DECISIONS YOU MAKE IN REAL-WORLD SCENARIOS. YOUR SAFETY AND COMPLIANCE WITH LOCAL LAWS ARE YOUR RESPONSIBILITY. IF YOU FEEL UNSAFE, ABANDON THE MISSION IMMEDIATELY.

THE MAXIMUM LIABILITY OF GHOST DIRECTIVE, IF ANY, WILL BE LIMITED TO THE AMOUNT PAID BY YOU TO US OR $500.00 USD, WHICHEVER IS LESS. CERTAIN JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES, IN WHICH CASE THESE LIMITATIONS MAY NOT APPLY TO YOU.

  1. Indemnification

You agree to defend, indemnify, and hold Ghost Directive harmless, including its subsidiaries, affiliates, and all respective officers, agents, and employees, from and against any claims, damages, liabilities, or legal demands arising from your participation in the game. This includes, but is not limited to:

  • Any violation of these Terms.
  • Any actions taken during gameplay that result in harm, disputes, or legal action.
  • Any breach of warranties or representations you make while participating.
  • Any harm caused to third parties due to your participation in missions.
  1. Purchases & Payment

We accept the following forms of payment:

  • Visa
  • Mastercard
  • American Express
  • Discover
  • PayPal

You agree to provide current, complete, and accurate account information for all purchases made through Ghost Directive, including subscription services. Payment details must be kept up to date, including billing address and card expiration dates. Sales tax may apply where required. Prices for all services and tiers are subject to change.

Ghost Directive reserves the right to limit or cancel orders placed through the service. We may, in our sole discretion, restrict purchases to specific users or geographic locations. We reserve the right to refuse any transaction we suspect may be fraudulent or violate our policies.

All sales are final. Refunds will not be issued except under extraordinary circumstances at Ghost Directive’s sole discretion.

  1. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal disputes shall be handled within the jurisdiction of Manatee County, Florida courts.

  1. Dispute Resolution

Informal Negotiations

To resolve disputes efficiently, both parties agree to first attempt an informal resolution. This process must be initiated before any formal legal action and must be pursued for at least 20 days before escalation.

Binding Arbitration

If informal negotiations fail, disputes will be settled exclusively by binding arbitration in Manatee County, Florida. The total amount that may be claimed against Ghost Directive, including all damages, fees, and costs, shall not exceed $500.00 USD. By agreeing to these terms, you waive your right to sue in court or have a jury trial. Arbitration will be conducted under the American Arbitration Association (AAA) Consumer Arbitration Rules, and the ruling will be final and legally binding.

  1. Termination & Enforcement

Players who violate game rules or engage in prohibited behavior will be subject to disciplinary action:

  • Ghosted: Immediate removal from the game, no reinstatement.
  • Burned: Permanent ban, blacklisting, and restricted access to all game-related services.
  1. Modifications & Updates

Ghost Directive may update these Terms of Service periodically. Continued participation in the game after updates constitutes agreement to the revised terms.
